Smith & Sons Insurance Agency, Inc. (“we,” “us,” “our”) offers text messaging services to provide updates, reminders, and other information to users who opt-in to our text messaging campaigns. By enrolling in our text messaging program, you agree to the following terms and conditions:
1. Enrollment and Consent
- By providing your phone number and opting into our text messaging campaign, you expressly consent to receive recurring marketing and non-marketing text messages from us, including but not limited to promotional offers, updates, reminders, and other notifications.
- Consent is not a condition of purchase. You can opt-in by texting a specific keyword (e.g., “JOIN”) to our designated number or by agreeing verbally in-person or over the phone, or by email.
- Messages may be sent via an automated system or manually.
2. Opt-Out
- You may opt-out of receiving text messages at any time by replying “STOP” to any text message you receive. After opting out, you will receive a confirmation text, and no further messages will be sent unless you re-enroll.

3. Message and Data Rates
- Standard message and data rates may apply to text messages sent and received as part of our program. These rates depend on your mobile carrier and plan.
- We are not responsible for any charges incurred by your mobile carrier.
4. Frequency of Messages
- The number of messages you receive will vary based on your interaction with us and your opt-in preferences. Typical automated campaigns may include 2–4 messages per month. By responding to a message, you should expect to receive more messages (replies) from us.
5. Privacy
- Your privacy is important to us. We will use your phone number only for the purpose of delivering text messages as described in these Terms and Conditions of Use and in accordance with our Privacy Policy.
- We will never share or sell your personal information to third parties without your consent, except as required by law.
6. Supported Carriers
- Text messages may be sent to most major U.S. mobile carriers. However, we do not guarantee that all carriers will support our text messaging service.
- Service may not be compatible with all devices or carriers.
7. Service Availability
- Text messaging services are provided on an “as is” and “as available” basis. We are not responsible for delays, failures, or errors in the delivery of text messages due to technical issues, carrier problems, or any other reason outside our control.
8. Changes to Terms
- We reserve the right to modify or terminate this text messaging service, or these Terms and Conditions, at any time. We will notify users of any changes by posting an updated version on our website and/or through text messages.
9. Liability
- To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from or connected to your use of our text messaging service.

11. Governing Law
